What is overtime pay?  

Overtime pay is the additional compensation that employees receive for hours worked beyond their standard working hours. It’s a higher rate of pay designed to compensate for the extended work hours. The rate for overtime is typically determined by labor laws and can vary depending on the country or region, the day of the week, and whether the overtime is worked on a holiday or rest day. 

Employers are required to track overtime hours accurately and compensate employees according to the regulations so as to ensure fair overtime pay policy and compliance.

Who is entitled to overtime pay?

Overtime pay is generally entitled to employees who work more than the standard working hours set by their employment contract or by Vietnam labor laws.

However, there are exceptions to this rule. Typically, the following groups may not be eligible for overtime pay or may have some restrictions for it:

  • Employees from 15 years old to under 18 years old. Labor laws usually restrict the number of hours that minor employees can work to prevent exploitation and ensure they have time for education and rest;
  • Employee being a mildly disabled person with a working capacity decrease of 51% or more, a severe disability, or a particularly severe disability;
  • Female employees who are pregnant from the 7th month or from the 6th month if working in the highland, remote, border, or island areas;
  • Female employees who are raising children under 12 months old.

Employers need to be aware of these exceptions and ensure that their payroll practices comply with the relevant labor laws to protect the rights of these groups of employees.

How to calculate overtime pay?

In Vietnam, calculating overtime pay involves more than simply multiplying an employee’s hourly wage by a fixed percentage. The Labor Code (Law No. 45/2019/QH14) and its accompanying decrees outline specific rules and limitations that employers must adhere to when compensating employees for overtime work.

It’s crucial to determine an employee’s base hourly wage, which serves as the foundation for overtime calculations.

The overtime pay rate is applied based on the day and time when the overtime work is performed:

  • Regular working days (Monday to Friday): 150% (1.5 times) of the base hourly wage for any additional overtime hours.
  • Weekends (Saturday and Sunday): 200% (2 times) of the base hourly wage for all overtime hours.
  • Public holidays and paid leave days: 300% (3 times) of the base hourly wage for all overtime hours.

To illustrate this formula for overtime pay with a practical example, consider an employee with a standard hourly wage of 100,000 VND. His base hourly wage would be calculated as follows:

  • On weekdays: 100,000 VND × 150% = 150,000 VND per overtime hour
  • On weekends: 100,000 VND × 200% = 200,000 VND per overtime hour
  • On holidays: 100,000 VND × 300% = 300,000 VND per overtime hour

It’s essential to keep in mind that there are strict limits on the number of overtime hours an employee can work. Article 107 of the Labor Code stipulates that overtime hours cannot exceed 50% of the standard working hours in a day, 40 hours per month, and 200 hours per year. In exceptional cases, the annual overtime limit can be increased to 300 hours with the notification to the relevant Department of Labor, Invalids and Social Affairs.

Furthermore, employers are required to obtain the employee’s consent for overtime work and ensure that they are provided with adequate rest periods between shifts. Failure to comply with these regulations can result in legal consequences and financial penalties.
