According to lawyer Thích, the processing of personal data as any activity that involves personal data, such as: collection, recording, analysis, verification, storage, editing, disclosure, combination, access, retrieval, recovery, encryption, decryption, copying, sharing, transmission, provision, transfer, deletion, and destruction. Regardless of the action, collecting and processing personal data requires the consent of the data subject and ensures the responsibilities of all involved parties, including the data subject, data controller, data processor, and third parties. “The consent of the data subject should be expressed in writing, via message, or verbally. Don’t equate silence with consent,” emphasized Lawyer Thích.
Following Mr. Thich, Ms. Ma Hong Van from Talentnet provided advice for businesses on establishing effective data management strategies in the context of Decree 13. She pointed out the challenges businesses are currently facing, including:
- Lack of awareness of compliance regulations
- New regulations with many points requiring specific guidance
- Coordination between departments within the business, employees, partners, and customers
- Limited common practices and standards for businesses to reference

In addition to analyzing the difficulties faced by businesses, Ms. Vân also pointed out what HR can do to ensure compliance with Decree 13, such as: assessing the actual practices of personal data processing in the HR department compared to the requirements of Decree 13 and developing solutions; continuously updating regulations and implementation practices. “HR must quickly adapt to the regulations of Decree 13 and incorporate risk management efforts at the strategic level to maintain and develop the business sustainably,” said Ms. Vân.
