Labor Regulations Update In September 2024 

Official Letter No. 2038/TLD-QHLD regarding the care and support for union members and workers affected by storm No.3 in 2024 

On 10th September 2024, the Vietnam General Confederation of Labor issued the Official Letter No. 2038/TLĐ-QHLĐ regarding the care and support for union members and workers affected by storm No. 3 in 2024. 

Accordingly, the Presidium of Vietnam General Confederation of Labor requests that the provincial and municipal Federations of Labor, central industry unions, and equivalents, and general company unions under the General Confederation proactively grasp the situation and provide support to union members and workers with the highest, quickest, and most timely spirit, directly to the families of workers affected by storm No. 3, specifically as follows: 

1. Proactively submit a written request to the Golden Heart Fund to support for union members and workers affected by storm No. 3 (according to the fund’s regulations) for the following groups:
   • Union members and workers who died due to the storm: 10 million VND per deceased person. 
   • Union members and workers who were seriously injured and required hospitalization: from 1 to 5 million VND per person.
2. For the localities and sectors directly affected by storm No. 3, depending on the level of property damage (houses with blown roofs, flood sweepings, landslides, houses needing immediate repairs, etc.), timely support will be provided to union members and workers to mitigate the consequences and stabilize their lives, with financial assistance ranging from 1 to 3 million VND per case (from the accumulated regular expenditure fund).

Official Letter No. 4136/TCT-QLN on gradual payment of tax debt and temporary suspension of departure

On 18th September 2024, the General Department of Taxation issued the Official Letter 4136/TCT-QLN regarding the gradual payment of tax debts and temporary suspension of departure. 

According to the guidance in this Official Letter, the Legal Representatives of an enterprise that is being forced to implement an administrative decision on tax will be subject to a departure suspension. In cases where there is sufficient evidence to determine that, at the time the tax authority issues a notice of departure suspension, the individual is no longer the Legal Representative of the enterprise that is being forced to comply, then that individual will not be subject to the departure suspension. 

Talentnet recommends that you uphold the spirit of compliance and review cases of tax debt to avoid the situation where the Legal Representative of the enterprise is subject to a departure suspension.
